The rule in brief
Unlike some other European cities, Berlin does not ban drinking alcohol in public. The city even regards drinking in parks as a normal use of those spaces, provided people stay considerate of others. In 2022, a Berlin administrative court suspended the nightly alcohol ban that the Mitte district had imposed in two parks, and the district did not reinstate it. There is therefore no permanent ban zone to learn, but three limits are worth remembering: the legal age, transport and common sense.
In the street, parks and by the water

A beer on a bench, a drink by the Landwehrkanal or a picnic with wine in the Tiergarten or Treptower Park are common. The guidelines are those of good manners:
- do not leave bottles and cans lying around: put them next to bins rather than in them so that deposit collectors can pick them up (see our guide to the bottle deposit);
- keep your voice down at night, as bar streets are also residential streets;
- avoid drinking on a children's playground.
A district or park may set its own temporary rules: read the signs at the entrance.
On the U-Bahn, tram and bus

The transport conditions of the VBB network, which apply to the BVG, forbid boarding vehicles with open drinks and consuming them during the journey. A sealed bottle in a bag is not a problem. People under the influence of alcohol who pose a danger to safety or to other passengers can be refused carriage. Smoking, e-cigarettes included, is banned in vehicles and on all platforms and in stations, except in marked areas; the BVG states a fine of 15 euros for a first offence. The Späti: buying to take away
The Späti (Spätkauf) is the corner shop that stays open late. You buy beer, soft drinks and snacks to take away, often cheaper than in a bar. Some accept cash only. Two points to know:
- Age: the youth protection law prohibits the sale of beer and wine under 16 (14 and 15 year olds only in the presence of a parent) and of spirits under 18. Keep ID with you.
- Sundays: Berlin's shop opening law requires shops to close on Sundays and public holidays, which officially applies to most Spätis. Inspections vary from district to district; see our guide to Berlin on Sundays to know where to buy on that day.
A deposit is added to the price of most bottles and cans: this is normal, and it is refunded when you return the empty container.
